Construction

In Puerto Rico, construction projects typically require various permits depending on the scope and nature of the project. Below is a list of common permits and approvals required for construction:

Use Permit

Required for the authorization of specific uses of land and buildings, including commercial, residential, or industrial purposes.

Construction Permit

The general permit for any new construction, modifications, or expansions of existing structures. This can include:

  • Structural modifications

  • Additions

  • Demolitions

Urbanization Permit

Needed for projects that involve the division or development of land for residential, commercial, or industrial use, including the creation of roads, infrastructure, or subdivisions.

Excavation Permit

​Required for any work that involves the removal or disturbance of soil, including excavations for foundations, pools, or basements.

Deforestation and Tree Cutting Permit

Necessary when tree removal is required during the preparation of land for construction.

Environmental Recommendation

​This is a report or evaluation issued by environmental authorities or specialists that provides recommendations regarding the potential environmental impact of a proposed project. It helps guide the project's planning to minimize negative environmental effects.

Sign Installation Permit

Required for the installation of outdoor signage or billboards, whether temporary or permanent, for commercial purposes.

Occupancy Permit

Issued after the completion of construction, certifying that the building or structure complies with all applicable codes and is safe for occupancy.

Permit for Signs

Separate from advertising, this applies to any signage used for naming or identifying a property or business.

Mechanical and Electrical Systems Permit

This covers the installation of mechanical systems such as air conditioning, heating, plumbing, and electrical installations.

Demolition Permit

Required for the demolition of existing structures, whether partial or full.

Landfill Permit

If the project involves large-scale landfilling or alteration of natural terrain, this permit ensures compliance with environmental standards.

No Objection Certificate

​Some municipalities may require this from neighboring properties, especially for projects that may affect adjacent landowners.

Noise Control Permit

​For projects that involve significant noise, especially in residential or mixed-use areas, this permit may be required to ensure compliance with local noise ordinances.

Alignment Permit

Necessary to ensure that a building or structure follows the correct alignment relative to streets, sidewalks, or other public spaces.

Hazardous Waste Permit

For any construction involving the handling, removal, or disposal of hazardous materials, such as asbestos, lead, or chemical waste.

Fire Department Permit

This permit is necessary to ensure that the building complies with fire safety regulations, including fire exits, sprinkler systems, and emergency lighting.

AAA Permit

Required for projects that need connections to the public water and sewer systems.

LUMA Permit

For projects that involve the installation or modification of electrical services, connections to the power grid, or new electrical infrastructure.

Land Use Permit

A broader permit that ensures the proposed use of the land complies with zoning and land-use plans.

Archaeological Permit

For projects in areas of historical or archaeological significance, this ensures that any cultural or historical resources are preserved.

Environmental Quality Board Permit

Zoning Certification

Confirms that the project adheres to the zoning restrictions and classifications for the specific location.

Earth Movement Permit

For projects involving significant earthmoving or grading activities, ensuring stability and minimizing landslide risks.

Location Consultation

This is a process used to determine if the proposed location for a development project complies with local zoning regulations and land-use plans. It ensures that the land is suitable for the intended purpose before moving forward with the project.

Wall or Fence Construction Permit

Required for the installation or modification of walls or fences on the property.

These permits are regulated by various agencies, such as the Oficina de Gerencia de Permisos (OGPe), Junta de Planificación, LUMA Energy, Autoridad de Acueductos y Alcantarillados (AAA), Cuerpo de Bomberos, among others.
